1. Scope of Application
The following General Terms and Conditions (GTC) apply to the use of this website and the business relationship between Adseto Hostettler and its customers. The version of these GTC that is valid and available at the time of accessing the website or placing an order applies. The products and services offered on this website are exclusively for customers in Switzerland and Liechtenstein.
A customer is defined as any natural or legal person who maintains a business relationship with us. The GTC, the delivery and payment terms, and the data protection regulations may be amended from time to time. We ask that you read these provisions carefully each time you visit the website and place an order.
The operator of this website is Adseto Hostettler (Legal Notice).
2. Information on this website
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. All information on www.marife.ch (product descriptions, images, videos, dimensions, weights, technical specifications, accessory compatibility, and other details) are to be understood as approximate values only and do not constitute any assurance of properties or guarantees, unless explicitly stated otherwise. We strive to provide all information on this website accurately, completely, and up-to-date; however, we cannot provide any express or implied warranty for this.
All offers on this website are subject to change without notice and are not to be understood as binding offers. Adseto Hostettler cannot guarantee that the listed products will be available at the time of ordering. Therefore, all information regarding availability and delivery times is without guarantee and is subject to change at any time without notice.
3. Prices
Unless otherwise stated, prices include statutory VAT. Prices are net in Swiss francs (CHF). Shipping costs, if any, will be charged separately and are payable by the customer. Shipping costs are shown separately during the order process.
Technical changes, errors, and misprints are reserved. In particular, Adseto Hostettler reserves the right to change prices at any time without prior notice.
4. Conclusion of Contract
The offers on this website constitute a non-binding invitation to order products and/or services from us. By clicking the "Order now" button, you submit a binding order for the goods in your shopping cart. By placing an order via this website and accepting these Terms and Conditions, you submit a legally binding offer to conclude a contract. We will then send an automatic "Order Confirmation" by email, confirming that we have received your offer. Orders placed are binding.
If, after conclusion of the contract, it becomes apparent that the ordered goods cannot be delivered, or cannot be delivered in full, Adseto Hostettler is entitled to withdraw from the entire contract or from a part thereof. If payment has already been received, it will be refunded. If no payment has yet been made, you will be released from your payment obligation. In the event of contract termination, Adseto Hostettler is not obligated to provide a replacement delivery.
5. Payment Options and Retention of Title
Payment can be made by invoice, prepayment, PayPal, credit card, PostFinance, Apple Pay, or Bitcoin. The terms and conditions of the respective providers apply. Discounts are not available. We reserve the right to offer you only certain payment methods for the requested delivery, for example, to mitigate our credit risk, only those corresponding to your creditworthiness.
The delivered products remain the property of Adseto Hostettler until full payment has been received.
5.1 Payment and Dunning Guidelines
(For purchases on account in Switzerland and Liechtenstein)
Payment Terms:
Invoices are payable within 10 days of the invoice date without deductions.
Payment is made by bank transfer to the account specified on the invoice.
Note to Customers: Please always include the invoice number in the payment reference so that we can correctly allocate your payment. After the payment deadline has passed, the customer is automatically in default (pursuant to Art. 102 of the Swiss Code of Obligations). From this point on, default interest of 5% per annum may be charged.
Dunning Process:
1st reminder 5 days after the due date. Fee: CHF 0.00
2nd reminder 10 days after the 1st reminder. Fee: CHF 10.00
3rd and final reminder 5 days after the 2nd reminder. Fee: CHF 20.00
If payment is not received after the third reminder, the claim will be transferred to a debt collection agency or legal action will be taken.
6. Delivery, Inspection Obligation, Notification of Defects
Delivery generally takes place within 5 to 10 business days of ordering. Deliveries are sent by mail to the address provided by the customer in the order. Invoices are issued by email or post. Risk of loss or damage to the goods passes to the customer upon dispatch, to the extent permitted by law.
If delivery is not possible or the customer refuses to accept delivery, Adseto Hostettler may, after sending written notification by email to the customer and setting a reasonable deadline, terminate the contract and invoice the customer for any resulting expenses.
Cash-on-delivery packages that are not collected from the post office and are returned to Adseto Hostettler unopened will be subject to a fee of CHF 50.00.
Adseto Hostettler reserves the right to demand reasonable compensation for damage, excessive wear and tear, or loss of value due to improper handling and to deduct the depreciation from the purchase price already paid or to invoice the customer accordingly.
The customer is obliged to inspect the delivered goods immediately upon receipt of the delivery and to report any defects for which Adseto Hostettler provides a warranty without delay in writing by email (info@marife.ch).
7. No Right of Return
We do not offer a return guarantee for incorrectly ordered or unsuitable goods.
8. Warranty
Should delivered items exhibit obvious material or manufacturing defects, including transport damage, please report such defects immediately to us or to the Swiss Post employee delivering the items. Failure to report such defects, however, does not affect your statutory rights. For all defects in the purchased goods that occur during the statutory warranty period, Adseto Hostettler reserves the right to provide a warranty, at its discretion, by free repair, equivalent replacement, or a refund of the purchase price. Further claims are excluded.
9. Unavailable Items
Should an item be unavailable, we undertake to inform you immediately of its unavailability and to promptly refund any payments received.
10. Liability
Adseto Hostettler excludes all liability and claims for damages, including those of its agents and any subcontractors. We are not liable, in particular, for indirect damages and consequential damages, lost profits, or other personal injury, property damage, or purely financial losses incurred by the customer. This excludes any mandatory statutory liability, for example, for gross negligence or willful misconduct.
Our website contains links to other websites. For all these links, we expressly declare that we have no influence whatsoever on the design and content of the linked websites. Therefore, we hereby expressly distance ourselves from all content on all linked third-party websites and do not adopt this content as our own. This declaration applies to all displayed links and to all content on the websites to which these links lead.
11. Other Provisions
We are entitled to amend or supplement these Terms and Conditions if changes in legal, regulatory, or technical framework conditions have led to a more than insignificant disruption of the balance between performance and consideration, or to a contractual gap, or if a supplement is necessary due to the introduction of new functions on our platform and the amendment is reasonable for you, taking your interests into account.
Should individual provisions of these Terms and Conditions prove or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
In the event of disputes, Swiss substantive law shall apply exclusively, excluding any conflict of laws rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.
The place of jurisdiction is Bern, unless mandatory legal provisions stipulate otherwise.
12. Image Rights
All image rights belong to Adseto Hostettler. Use without express permission is prohibited.
